If permission is granted to raise the quantum of a claim after issue...

If permission is granted to raise the quantum of a claim after issue to a figure within a higher fee band but the claim started its life on Money Claims OnLine, which fee scale governs the additional fee payable—the general scale or the Money OnLine scale?

There is no express provision in the relevant subordinate legislation to cover this situation but we suggest that the balance of the fee on the Money Claims OnLine scale is the appropriate one which will be lower than under the general scale.
