Evangelou and others v McNicol (sued as a representative of all members of the Labour Party except the Claimants) [2016] EWCA Civ 817, [2016] All ER (D) 50 (Aug)
The Queen’s Bench Division allowed the claimant members of the Labour Party’s claim against the defendant General Secretary of the Party. For the Party to refuse to allow them to vote in the leadership election, because they had not been members since 12 January 2016, would be unlawful as a breach of contract.
