GMB Northern v Cable Realisations Ltd [2009] All ER (D) 179 (Nov)

Regulation 13(2) of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246) on its true construction, was designed not only to put at rest the minds of affected employees as far as possible at a time of impending changes, but was designed to allow the representatives of those employees to engage in a consultation process with the employer on an informed basis; whether the employer was obliged to engage in such a consultation exercise was dependent on reg 13(6).
