The General Court of the European Union dismissed the action brought by Naazneen Investments Ltd (Naazneen) against the decision of the Second Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs), relating to revocation proceedings between Energy Brands, Inc. and Naazneen regarding the registration by Naazneen’s predecessor of the word mark “SMART WATER” as a Community trade mark.
