Extradition

The Administrative Court allowed the appellant’s appeal against orders for his extradition to Poland to face trial for fraud. The judge had wrongly concluded that it had been proportionate and not oppressive to extradite the appellant, given the unresolved request for less coercive measures, misdirection and irrelevant considerations as to fugitive status, the mental illness of the appellant’s wife and the delay.
