The Secretary of State for the Home Department v CT (Vietnam) [2016] EWCA Civ 488, [2016] All ER (D) 02 (Jun)

The Court of Appeal allowed the appellant Secretary of State’s appeal against the decision of the Upper Tribunal (Immigration and Asylum Chamber), protecting the respondent Vietnamese national from deportation. Neither the British nationality of the respondent’s children nor their likely separation from their father were exceptional circumstances which outweighed the public interest in his deportation.
