The Supreme Court has granted permission to appeal the “Iraqi Civilian litigation” in which several hundred Iraqi civilians seek damages for allegedly unlawful detention and ill-treatment by British armed forces.
The case concerns whether procedural provisions in Iraqi law on limitation and immunity apply in the English courts.
In December, the Court of Appeal found that the claimants were time-barred, in Ministry of Defence v Iraqi Civilians [2015] EWCA Civ 1241. The case is likely to be listed in April.
