Charles Church Developments Ltd v Stent Foundations [2006] All ER (D) 54 (Dec):

Section 35(5)(a) of the Limitation 1980 and the expanded interpretation of CPR 17.4(2) give the court a discretion, after the expiry of the limitation period, to allow a claimant to plead a new cause of action based upon the same facts as have been pleaded by another defendant.
