R (Meredith) v Harwich Magistrates’ Court [2006] All ER (D) 45 (Dec):

For a statement to be admissible under s 116(2)(b) of the Criminal Justice Act 2003 (CJA 2003), the prosecution has to establish beyond reasonable doubt that witnesses are unfit to be witnesses because of their bodily or mental condition.
