R v Livesey [2006] All ER (D) 241 (Dec)

Where judges uphold a submission of no case to answer in respect of a count to which there is a statutory alternative verdict, they are entitled to leave the count on the indictment to allow the jury to return a verdict on the statutory alternative offence.
