Contract

Deutsche Bank AG v Asia Pacific Broadband Wireless Communications Inc [2008] EWCA Civ 1091, [2008] All ER (D) 104 (Oct)

A jurisdiction clause is a separable agreement from the agreement as a whole. It follows that disputes about the validity of the contract must be resolved pursuant to the terms of the clause. It is only if the jurisdiction clause is itself under some specific attack that a question can arise whether or not it is right to invoke the jurisdiction clause.
