Lexis®Library update: In the report, the JCHR has urged the government not to proceed with the Bill, and has suggested that the Bill would obstruct the principle of judicial review and undermine the Human Rights Act 1998 (HRA 1998) by creating large scale uncertainty, damaging people’s ability to enforce their rights, and would likely result in more people needing to go to the European Court of Human Rights to enforce their rights leading to an increase in adverse judgments made against the UK.
The Committee has also stated that it should not be a priority for the government in the current economic and political climate and have questioned whether the Bill should continue to be considered at all.
