LNB News: MoJ publishes guidance on court fees incurred under new PI small claims track

The Ministry of Justice (MoJ) has released guidance on the type of court fees that are incurred in court proceedings brought under the new Practice Direction 27B, which governs personal injury claims arising from road traffic accidents where the claimant expects to recover less than £5,000 in pain, suffering and loss of amenity damages. 

Lexis®Library update: The guidance notes that the court fees may comprise an issue fee of between £35-455, a hearing fee of between £25-335, and/or an application fee of £255. The issue and hearing fees will differ depending on the value of the claim, and may be varied if the value of the claim changes after proceedings have commenced. If the claim is successful, the court has discretion to order the defendant to reimburse a claimant for any incurred fees.
