Supreme Court to hear Prudential v HMRC appeal

The Supreme Court will hear the appeal in the Prudential v HMRC case, on the boundaries of legal professional privilege, on 6 November 2012. The Law Society has been given permission to intervene. In October 2010, the Court of Appeal unanimously held that legal professional privilege does not extend to non-lawyers. Prudential had sought to extend privilege to advice on tax law given by accountants, thus allowing it to withhold that advice from bodies such as HMRC.
