The Chancery Division clarified the legal framework against which decisions of the secretary of state concerning special payments in respect of the abstraction of water from the River Lee were to be made, and in the context of a dispute between the claimant Canal & River Trust and Thames Water Utilities Ltd concerning the amount of payments Thames Water Utilities Ltd was to make to Canal & River Trust in respect of water it abstracted from the River Lee.
