Weapons sentencing guidelines set for overhaul

The Sentencing Council is consulting on three new and three revised guidelines for ‘Bladed article and offensive weapon etc offences’

One proposal is to extend the existing ‘bladed article and offensive weapons offences–children and young people’ guideline so it can be used for a wider range of offences. The revised guideline would recognise factors such as coercion, intimidation, exploitation and grooming.

The proposed new guidelines are ‘threatening with an offensive weapon, bladed article or corrosive substance in a private place’ and guidelines relating to possession in private and possession with intent to use unlawful violence.

Sentencing Council member Mr Justice Mark Wall KC said: ‘The law relating to knives, offensive weapons and corrosive substances has evolved significantly in recent years.

‘These proposals make sure sentencing guidelines keep pace with those changes, reflect the seriousness of weapon-related offending and support courts in delivering fair and consistent sentences.’

The consultation closes on 6 January.
