Brexit case dismissed

A legal case to determine whether the Article 50 notice can be revoked unilaterally or whether the consent of the other 27 EU member states is required has been dismissed by the Court of Session in Edinburgh. The judicial review was brought by a cross-party group of MSPs (Members of the Scottish Parliament). However, Lord Doherty ruled this week, at [2018] CSOH 8, that the action had no real prospect of success, stating the question was ‘hypothetical and academic’ since ‘neither Parliament nor the government has any wish to withdraw the notification’.
