AmTrust Europe Ltd v Trust Risk Group SpA [2015] EWCA Civ 437, [2015] All ER (D) 17 (May)
The parties, which were both involved in insurance, entered into a standard terms of business agreement. The claimant company sought a mandatory injunction that money which had been removed from an account by the defendant company be repaired. The trial judge held that the defendant had made out a “good arguable case” on jurisdiction and that the courts of England and Wales had jurisdiction in relation to disputes. The claimant appealed, and the Court of Appeal dismissed the appeal.
