Carillion JM Ltd v PHI Group Ltd [2011] EWHC 1581 (TCC), [2011] All ER (D) 19 (Jul)

It was established law that it did not follow automatically that simply because the court had established a particular apportionment of liability as between a defendant and a third party, the claimant’s costs had to be payable by the third party in the same proportion. The court had an overall discretion to award an appropriate costs order.
