Nabili v Norfolk Community Health and Care NHS Trust UKEAT/0039/16/RN, [2016] All ER (D) 200 (Jun)

The Employment Appeal Tribunal (EAT), in allowing the employee’s appeal against the employment tribunal’s dismissal of her claim for unfair dismissal, held that the tribunal had erred in concluding that the employer proceeding with a disciplinary hearing in the employee’s absence had not rendered her dismissal unfair. The decision dismissing the unfair dismissal claim was set aside and the claim was remitted.
