According to European case-law, judicial review of the lawfulness of a measure whereby restrictive measures had been imposed on an entity extended to the assessment of the facts and circumstances relied on as justifying the measure, and to the evidence and information on which that assessment was based. In the event of challenge, it was for the Council to present that evidence for review by the EU judicature.
