The General Court of the European Union dismissed an action brought by Pro-Aqua International GmbH seeking an annulment of the decision of the Second Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) relating to the registration by Rexair LLC of a word mark “WET DUST CAN’T FLY” as a Community trade mark.
