C and another v E and others [2016] EWHC 2643 (Fam), [2016] All ER (D) 33 (Nov)

The Family Division held that it was not in a position to make either a parental order under the Human Fertilisation and Embryology Act 2008, as the element of consent was missing, or an adoption order under s 67(1) Adoption and Children Act 2002, as it would mean in effect that the parents were adopting their own children. The applications were not able to be determined.
