Injunction

Rochester Resources Ltd and others v Lebedev and another [2014] EWHC 2926 (Comm), [2014] All ER (D) 67 (Sep)

The Commercial Court dismissed the claimants’ application for an injunction pursuant to s 37 of the Senior Courts Act 1981 to restrain the first defendant from pursuing or taking any step in proceedings commenced against the second and third claimants in the Supreme Court of New York. The court held that the claimants had failed to establish that there was a high degree of probability that the first defendant was obliged to arbitrate his claims.
