Impala Warehousing and Logistics (Shanghai) Co Ltd v Wanxiang Resources (Singapore) PTE Ltd [2015] EWHC 811 (Comm), [2015] All ER (D) 298 (Mar)
The proceedings concerned the attempted purchase of aluminium by the defendant company, Wanxiang, from a company linked to the claimant. The Chinese government prevented the sale of goods from the warehouse where the aluminium was kept as part of a criminal investigation. The defendant commenced proceedings in Shanghai. The claimant objected to the jurisdiction on the ground that, under certain warehouse certificates, the English courts had exclusive jurisdiction. It sought an anti-suit injunction to prevent continuation of the Shanghai proceedings while the matter was considered in England. The Commercial Court held that, in the circumstances, the injunction would be granted.
