A landmark ruling recently handed down by Sir Andrew McFarlane, formerly Britain’s most senior family court judge, has raised important questions about the law surrounding sperm donation.
The background
Re N (Paternity: Unregulated Sperm Donor) [2026] EWHC 878 (Fam) concerned a prolific unregulated sperm donor known as ‘Joe Donor’—real name Robert Albon—who claims to have fathered more than 180 children worldwide. He provides sperm privately, outside any regulated fertility clinic, and receives payment from recipients.
In 2021, a child referred to in proceedings as N was born to a mother (Ms JE) following a private arrangement with Mr Albon. Ms JE's partner at the time, EF, a transgender man, was registered on N's birth certificate as ‘father’.
