The accused was charged with a public order offence involving swearing at police officers. It was argued that his comments should be excluded because he had not been cautioned before making them.
HELD The provisions of Code C are not directed to what a defendant was alleged to have said as part of the conduct constituting the alleged crime but to what a defendant was alleged to have said on or after arrest.
