YL v Birmingham City Council and others [2007] UKHL 27, [2007] All ER (D) 207 (Jun)

In providing care and accommodation, a care home is not exercising functions of a public nature within s 6(3)(b) of the Human Rights Act 1998. The actual provision, as opposed to the arrangement, of care and accommodation for those unable to arrange it themselves is not an inherently governmental function.
