R (on the application of Rights of Women) v Lord Chancellor and another [2016] EWCA Civ 91, [2016] All ER (D) 177 (Feb)

The Court of Appeal, in allowing the claimant’s appeal, declared that reg 33 of the Civil Legal Aid (Procedure) Regulations 2012 (SI 2012/3098), was invalid insofar as it: (i) required verifications of domestic violence to be given within a 24-month period before any application for legal aid; and (ii) did not cater for victims of domestic violence who had suffered from financial abuse.
