LNB NEWS: CPS publishes speech on legislation application to contemporary crime

The Crown Prosecution Service (CPS) has published a speech by the Director of Public Prosecutions, Max Hill KC, to the Oxford University Law Faculty on 24 February 2023 which highlights how prosecutors apply centuries of legislation to contemporary crime.

Lexis®Library update: Hill, in the speech, explains the role of the CPS, that it is headed by the Director of Public Prosecutions, who issues a Code for Crown Prosecutors. The Code itself explains how the CPS approaches the decision to prosecute, is based on principles of evidential sufficiency and public interest and sets out how to consider the public interest in prosecuting.

Hill has also highlighted that the CPS issues prosecution guidance, giving more information on how to apply the Code in specific cases. Hill gives an example of an assault case and assisted suicide case study and then highlights the importance of transparency, consistency and fairness to the CPS, ending with a few words on working with the CPS.
