R (on the application of Edwards- Sayer) v Secretary of State for the Home Department [2008] EWHC 467 (Admin), [2008] All ER (D) 176 (Mar)

A person who has pleaded guilty to an offence but has not yet been sentenced for that offence is a “convicted prisoner” within r 2(1) of the of the Prison Rules 1999 (SI 1999/728) and so loses the rights and privileges of being a remand prisoner.
