Serle
Court has welcomed Michael
Walsh and Sparsh
Garg as members of Chambers, further strengthening the set’s commercial
chancery offering.
Michael
Walsh (pictured), called 2006, specialises in all aspects of the law of property, and
also undertakes general commercial chancery work, frequently appearing in the
Court of Appeal, High Court, County Court, and Tribunals. In addition, he
advises on a wide range of professional liability matters. He receives regular
instructions in cases and projects where development finance, securities,
planning, and compulsory purchase intersect with the law of real property.
Michael draws on his broad expert knowledge to advise clients on how to best
achieve their strategic goals in complex cases and transactions.
Michael
has significant experience of commercial and contractual disputes across a
variety of sectors, including financial services, leisure, retail, and the
hospitality industry.
Sparsh
Garg, called 2017, has a broad commercial chancery practice, with a
particular focus on trusts and estates litigation, company and insolvency,
civil fraud and commercial disputes.
Sparsh
is regularly instructed as sole counsel or as part of a larger counsel team in
both English and international litigation/arbitral proceedings. He has acted or
advised in relation to disputes before the English High Court, as well as
matters in Gibraltar, The Bahamas, Bermuda, BVI, Cayman Islands, the DIFC,
Guernsey, Jersey, and in LCIA/LMAA arbitrations.
Kathryn
Purkis, Chambers Director commented:
Michael
was called to the Bar in 2006 and was appointed by the Attorney General to the
A Panel of Junior Counsel to the Crown in 2021. Michael is currently instructed
on a commercial claim against a government department for damages in excess of
£40 million. He has also advised many government departments on a range of real
estate matters, such as overage agreements, lease break notices, and a large
and complex arbitration in connection with government property.
Michael
frequently advises in difficult mortgage and security related disputes where
the lender is enforcing either by itself or through receivers. Recent work
includes Pitt & Others
v Bodani [2022] EHWC, which was a claim against Michael’s client
for possession of a valuable Mayfair flat and for money judgment of $20 million
in respect of a cross-border loan facility to the Defendant’s father’s offshore
company, the debts of which she guaranteed. The bank also claimed subrogation
to an earlier charge in light of the Defence.
Sparsh was called to the Bar in 2017. In a short period of time Sparsh has built up considerable experience in the offshore and international sphere. He has now twice appeared in the Privy Council, acting for the appellant in Chu v Lau [2020] 1 WLR 4656 (led by Philip Jones KC), and more recently for the appellants in Perry v Lopag. On the domestic front, Sparsh acted for the successful respondent in Tatishev v Zimmerz Management LP [2022] BPIR 606, concerning an application to set aside a statutory demand on the grounds of common mistake and misrepresentation. He is currently instructed on large matters before the courts of England, Gibraltar and Jersey.
