Smith to be appealed

The government is to appeal the Court of Appeal ruling that members of the armed forces have the same basic human rights as all citizens.

The government is to appeal the Court of Appeal ruling  which considered Private Jason Smith’s unnecessary death from heat stroke in Iraq in 2003. Jocelyn Cockburn of Hodge Jones and Allen LLP, who represented Jason Smith’s mother, said: “It’s outrageous that the MoD is appealing this case again, having lost at first instance and then on appeal.
