Leslie v Farrar Construction Ltd [2016] EWCA Civ 1041, [2016] All ER (D) 102 (Nov)

The Court of Appeal held that the claimant’s appeal against the decision of the trial judge regarding overpayment would be dismissed. The court found that when the claimant had made the final payments on each of the five completed developments, he was not acting on the basis of a mistake or under the influence of an erroneous assumption. He had taken a conscious decision to pay the sums requested without investigation, because that suited his purposes.
