The Legal Services Act 2007, s 194 with secondary legislation will be put fully to work in October 2008. Eh? This will enable an award of costs in civil proceedings where legal representation has been given free of charge. There will be no exception for family cases. And who is to benefit? The pro bono representative or the El Vino bar kitty? Neither. A prescribed charity will be the sole object of pro bono costs and it will administer and distribute to voluntary organisations that provide legal support for individuals and the community. Any preference expressed by the representative will be taken into account.
