MPs and Peers are calling for written evidence on the government’s intention to derogate from the European Convention on Human Rights before embarking on future military operations.
The intention was announced in HC Deb 10 October 2016 WMS45, Military Operations: European Convention on Human Rights Derogation. The Joint Committee on Human Rights asked the Defence Secretary to explain why the derogation is necessary, including evidence, and to address specific questions raised by the Committee. The Defence Secretary replied that he could not answer the questions at this time as the government had only announced its intention to derogate.
The Committee is calling for submissions of no more than 3,000 words from interested groups and individuals by 31 March 2017, and has set out a list of specific questions.
