New tribunal regulations following employment review
New regulations for employment tribunals have been published following Lord Justice Underhill’s review last year. The Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 (SI 2013/1237) provide that claim forms will be rejected if not accompanied by the appropriate fee; give extra case management powers to tribunal judges; change the rules on default judgments; change nomenclature and practice; and enable judges to assess costs in a wider range of cases. They come into force for claims where the respondent receives the claim form from the tribunal on or after 29 July 2013.
