Novartis AG v Office for Harmonisation in the Internal Market (Trade Marks and Designs) T-444/12, [2014] All ER (D) 196 (Oct)

The Court of Justice of the European Union allowed the action brought by Novartis AG (Novartis) for annulment of the decision of the Fourth Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) relating to opposition proceedings between Tenimenti Angelini SpA and Novartis concerning the application by Novartis for registration of the word mark “LINEX” as a Community trade mark.
