Moghal v Hudda [2008] All ER (D) 109 (Sep) (EAT)

In a claim for constructive dismissal where the allegation is a breakdown of the trust and confidence between the employer and the employee arising from a number of alleged incidents spread over a period of time, it is necessary for the tribunal to make clear findings and to give reasons for those findings in relation to the overall nature of the complaints being made by the employee. An alternative method is to make findings as to the credibility of the parties, with sufficient reasons as to why the tribunal has come to a particular view on credibility.
