Islington London Borough Council v Honeygan-Green [2007] EWHC 1270 (QB), [2007] All ER (D) 458 (May)

The right to buy “cannot be exercised” under s 121 of the Housing Act 1985 if the tenant was obliged to give up possession. However, the revival of the old tenancy revives the statutory right to buy, though not any previous application lost by virtue of the operation of s 121.
