Re L (a child) (shared residence order) [2009] EWCA Civ 20, [2009] All ER (D) 220 (Jan)

A shared residence order (s 8 of the Children Act 1989), settling the arrangements to be made as to the persons with whom a child is to live, can properly be made where there is a substantial geographical distance between the parties.

The court has to examine the underlying factual matrix, and to decide in all the circumstances of the case whether or not it is in the child’s interest to relocate with the parent who wishes to move.
