LNB NEWS: CPS launches consultation on draft guidance on deception as to gender in sexual assault

The Crown Prosecution Service (CPS) has launched a consultation seeking views on the draft legal guidance for deception as to gender in rape and serious sexual assault cases.

Lexis®Library update: This regards whether deception as to gender should affect consent, and addresses the circumstance where a suspect’s gender identity differs from the sex they were assigned at birth, offering further clarity to the Gender Recognition Act 2004 (GRA 2004), which allows individuals to have their affirmed gender recognised in law.

The consultation contains eight questions, including whether any evidential considerations and public interest factors should be added, removed or amended, and whether the language is appropriate. The consultation will run until 19 December 2022.
