LNB news: Proposals to monitor and report on domestic abuse in private law children cases

The Domestic Abuse Commissioner has published a report on the proposals for the establishment of the monitoring mechanism

Lexis®Library update: This includes what the monitoring mechanism should look like and how it can help bring change for domestic abuse, victims and their children. The mechanism will improve accountability and transparency in the family courts, through additional data and understanding of how private law children cases are treated. Following the report, the next stage is to prepare a full design for the pilot phase of the mechanism, which is anticipated to be completed in early 2022 and to commence in spring 2022.

The monitoring mechanism was recommended following the government’s Harm Panel report and aims to address the failings identified. The mechanism will ensure that the courts and subsequent outcomes are safer for children, by increasing the data and evidence available surrounding domestic abuse related cases in the family court and improve consistency around the country.
