R (on the application of CXF (acting by his mother, his litigation friend)) v Central Bedfordshire Council and another [2017] EWHC 2311 (Admin), [2017] All ER (D) 77 (Sep)

The Mental Health Act 1983 s 117 duty to provide after-care services was not triggered whenever a patient detained under s 3 was granted leave of absence under s 17. The Administrative Court held that the question was whether, on the facts of the particular case, the patient had ceased to be detained and had left hospital, satisfying the pre-conditions in s 117(1).
