New family rule

Tougher test for expert witnesses

A new rule has come into force imposing a tougher test when deciding whether to admit expert witnesses in family cases. Family judges can now only allow expert evidence if it is “necessary”. Previously, experts would be heard if this was “reasonably required”. The new rule is one of the recommendations made by Sir David Norgrove, in his review of family justice in 2011.
