A practice direction staying all claims which examine the question of when a company’s director and majority shareholder counts as an employee of that company has been issued by the president of the employment tribunals. Claims involving this issue will be put on hold until after the Court of Appeal gives judgment in Secretary of State for Business, Enterprise and Regulatory Reform v Neufeld which is listed for hearing on 3 and 4 December 2008.
