The Court of Appeal will consider whether it is legitimate for a solicitor, representing a client on a conditional fee agreement, to indemnify his client in the event of the claim failing.
It was held in Dix v Townend [2008] that this arrangement put the solicitor in the wrong and a bill of more than £70,000 was disallowed. Although MacDuff J in Morris v London Borough of Southwark [2010] ALL ER (D) 103 (Apr) held that such an arrangement could be unlawful, he upheld the arrangement here because claims so funded were small and few in number. Waller LJ granted leave to appeal last month.
