LNB news: Court of Appeal quashes convictions in 39 Post Office cases after CCRC referral

The Criminal Cases Review Commission (CCRC) has reported that the Court of Appeal has quashed the convictions in 39 Post Office cases that had been referred for appeal by the CCRC
Lexis®Library update: The Court of Appeal held that the Post Office’s failures of disclosure and investigation were ‘so egregious as to make the prosecution of any of the Horizon cases an affront to the conscience of the court’. The CCRC has further outlined that it is aware of ‘several hundred prosecutions’ identified by the Post Office that have been brought since the Horizon system was installed—the Post Office is reviewing those cases to ascertain whether these current appeal proceedings could have implications on those too. Issues with the Horizon computer system are where the grounds for appeals stem, concerning uncertainty of the safety of convictions.

CCRC Chairman, Helen Pitcher, commented on the Court of Appeal decision: ‘This has been a serious miscarriage of justice which has had a devastating impact on these victims and their families. Every single one of these convictions has clearly had a profound and life-changing impact for those involved. Six convictions had already been quashed which had been referred to Southwark Crown Court.

The Post Office has rightly acknowledged the failures that led to these cases and conceded that the prosecutions were an abuse of process. We sincerely hope that lessons will be learned from this to prevent anything similar happening elsewhere in the future.’

The CCRC encourages anyone who believes that their criminal conviction could be unsafe due to the impact of their case of performance issues with the Horizon computer system to consider challenging their conviction.
