LNB NEWS: New standard orders on cross-examination and QLR provisions

With the authority of the President of the Family Division, Mr Justice Peel, as the judge in charge of the Standard Orders Group, has issued a series of draft orders prepared by the Ministry of Justice after consultation with relevant stakeholders and a review by the Standard Orders Group. 

Lexis®Library update: The orders address the requirements of the Domestic Abuse Act 2021 (DAA 2021) as to the prohibition of cross examination and the appointment of a qualified legal representative (QLR), which came into force on 21 July 2022 and apply to all family proceedings commenced after that date.

As the DAA 2021 provisions are already in force, the orders have been made available on an interim basis pending publication of the full suite of standard orders. The orders will apply until further notice and appear in their final form in the suite of standard orders, which is currently subject to a comprehensive review by the Standard Orders Group.

The new standard orders are:

• Order 24.1—Domestic Abuse—Order for Completion of Required Forms

• Order 24.2—Domestic Abuse—Order for Consideration of Appointing Qualified Legal Representative

• Order 24.3—Domestic Abuse—Order to Appoint Qualified Legal Representative

• Order 24.4—Domestic Abuse—Order for Termination of Appointment of Qualified Legal Representative

• Order 24.5—Domestic Abuse—Order to Enable Qualified Legal Representatives to Claim Fees

• Order 24.6—Domestic Abuse—Order for Appointment of Qualified Legal Representative

• Order 24.7—Domestic Abuse—Order about Court bundle or Court file
