How are the courts applying the law in relation to the issue of ‘parental alienation’? Luke Scarratt, senior associate at Payne Hicks Beach, investigates how the law is being applied and what tools the courts have at their disposal.

Scarratt writes: ‘Typically, this issue arises during a dispute concerning child arrangements when a child refuses to spend time (or limits their time) with one parent, in favour of another.’

He explains the difficulties in proving the issue and shares advice on what lawyers, clients and practitioners can do if ‘parental alienation’ is alleged.
